Terms of Service

1. Acceptance of Terms

By accessing or using the Purple Dragon Dojo Management System ("DMS" or the "Platform"), operated by Purple Dragon ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Platform.

These Terms apply to all users of the Platform, including dojo members, staff, administrators, and visitors.

2. Description of Service

The Platform provides martial arts school management tools including, but not limited to:

• Membership management and class scheduling.
• Attendance tracking and check-in.
• Billing, invoicing, and payment processing.
• Belt rank progression and curriculum tracking.
• Communication tools (email and SMS notifications).
• Point-of-sale for retail and merchandise.
• Member and family portal access.

3. Accounts & Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• Minor members (under 18) must have accounts created and managed by a parent or legal guardian.

4. Membership & Billing

4.1 Membership Plans

Membership plans, pricing, and terms are established by your dojo and presented at the time of enrollment. By enrolling in a membership plan, you authorize recurring charges as described in the plan terms.

4.2 Payment Authorization

• By providing a payment method, you authorize us to charge the applicable fees on the scheduled billing dates.
• Payments are processed securely through Authorize.net. We do not store raw credit card data.
• You are responsible for keeping your payment method current and valid.

4.3 Failed Payments & Late Fees

• If a scheduled payment fails, we will attempt to retry the charge as described in our billing policy.
• A late fee may be applied to overdue invoices as specified in your membership agreement.
• Continued failure to pay may result in membership suspension or termination.

4.4 Refunds & Cancellations

Refund and cancellation policies are determined by your dojo. Contact your dojo directly for their specific refund and cancellation terms. Cancellation requests must be submitted in accordance with your membership agreement.

5. SMS Communications

By opting in to SMS notifications, you consent to receive text messages from the Platform including class reminders, billing notifications, and other communications related to your membership.

• Message frequency varies based on your activity and dojo communications.
• Standard message and data rates may apply depending on your mobile carrier.
• You may opt out at any time by replying STOP to any message.
• Reply HELP for assistance with SMS communications.
• SMS consent is not a condition of membership or any purchase.
• Your consent information will not be shared with third parties for marketing purposes.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or Platform systems.
• Interfere with or disrupt the Platform or its infrastructure.
• Upload malicious code, viruses, or other harmful content.
• Scrape, harvest, or collect information from the Platform without authorization.
• Share your login credentials with unauthorized persons.
• Use the Platform to send spam or unsolicited communications.

7. Intellectual Property

The Platform, including its design, code, features, and content, is owned by Purple Dragon and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

Content you upload (photos, documents) remains your property. By uploading content, you grant us a non-exclusive license to store, display, and use it as necessary to provide the Platform services.

8. Assumption of Risk

Martial arts training involves inherent risks of physical injury. The Platform facilitates class scheduling, check-in, and membership management — it does not supervise or control training activities. You acknowledge that:

• Participation in martial arts classes is voluntary and at your own risk.
• You (or your child's guardian) are responsible for disclosing relevant medical conditions.
• The Platform is not liable for injuries sustained during training.
• Separate waivers and liability releases may be required by your dojo.

9. Limitation of Liability

To the maximum extent permitted by law, Purple Dragon and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

10. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to access the Platform ceases immediately.
• Outstanding payment obligations survive termination.
• You may request a copy of your data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Fulton County, Georgia.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a revised "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
